Understanding Capital Gains Tax
Short-Term vs Long-Term
Assets held 12 months or less are short-term and taxed at your ordinary income rate (up to 37%). Assets held more than 12 months qualify for preferential long-term rates: 0%, 15%, or 20% depending on income.
The Net Investment Income Tax (NIIT)
High-income taxpayers pay an additional 3.8% NIIT on the lesser of net investment income or the amount by which MAGI exceeds $200k (single) / $250k (MFJ). This applies to capital gains, dividends, interest, and passive rental income.
Capital Loss Harvesting
Realized losses offset gains dollar-for-dollar. Net losses up to $3,000 can offset ordinary income. Excess losses carry forward indefinitely. Beware the wash-sale rule: you cannot repurchase the same or substantially identical security within 30 days of the sale.
